Possible electoral improprieties by Charlottetown Liberal MP Shawn Murphy?

In a post I wrote September 16th , Liberal MP Shawn Murphy's dumbed down fairy tales for seniors, I was describing a document from Murphy's office that had arrived in my mailbox that morning entitled: "The Charlottetown Summer 2008 Report, Shawn Murphy, MP for Charlottetown." It was a mailer aimed at seniors, with one side containing info on sporting and senior facilities at UPEI, the Home Care Attendant Tax Credit, and MP contact info for Murphy. The other side, which I posted about, was headlined "Seniors and the Green Shift."

Shortly after posting, I had a closer look at the flyer, and noted something interesting - the complete absence of the requisite "Authorized by the official agent of Shawn Murphy" on the document. As clause 320 of the Canada Elections Act states:

Message must be authorized

320. A candidate or registered party, or a person acting on their behalf, who causes election advertising to be conducted shall mention in or on the message that its transmission was authorized by the official agent of the candidate or by the registered agent of the party, as the case may be.


Now I know that Canada Post, often referred to - in fond tones of course - as "Canada Haste," has sometimes been accused of being a tad slow. The writ was officially dropped September 7th and Murphy's mailer arrived September 16th - nine days later. It will be interesting to see what Elections Canada has to say about it.

With Prime Minister Harper and the Conservative Party doing so well on the campaign trail, Stéphane Dion's Liberals have been reduced to desperation tactics, some of which border on the illegal. A perfect example of this is a very recent mailout from St. Paul's Liberal MP Carolyn Bennett. As you know, during non-election periods, every MP is entitled to send out occasional non-partisan informational pieces to their constituents to tell them about developments on Parliament Hill and in the riding. These pieces are paid for using taxpayer funds. However, well over a week after the election was called, Ms. Bennett's campaign sent out via Canada Post, a transparently partisan Fall 2008 'Parliamentary Report.' The cover piece on 'Understanding the Green Shift' encourages readers to visit the Liberals' 'Green Shift' website and features a photograph of both Ms. Bennett and Stéphane Dion. Ms. Bennett's mailing is a blatant violation of election law. All pieces going out during a writ must be paid for by the campaign, not by taxpayers, and they must all say that they are authorized by the Official Agent of the campaign, none of which is true for this so-called 'Parliamentary Report.'

Commenter "Short Temper" at Dr. Roy's also claims that North Vancouver Liberal MP Don Bell sent out a similar report ten days after the writ was dropped.

Elections Canada states that:
If you have information about an offence that you believe was committed under the Canada Elections Act, send it to the Office of the Commissioner of Canada Elections.

I'll have to dig it out of my recycle bin re Don Bell and review if there's a post mark on it...fortunately I didn't burn it..

perhaps I can forward a scanned image to the media and blogs to post

There are no postmarks on the ones my neighbors and I received - it's a mass-mailing piece, just like a flyer. But you should go ahead and send a pic or scan or fax of it to the email in the link I provided - along with all the other stuff they ask for. (My email is under my profile if you want to send pics of the mailer for posting.)
